DriveAway GTG — Privacy Policy
1. Introduction and Your Consent
myGIGlife INC. ("Company," "we," "us," or "our") publishes DriveAway GTG (the "App"), including its companion tile for Wear OS watches. This Privacy Policy explains what information the App does and does not collect, how the information it handles is used and stored, which third parties are involved, and your rights with respect to that information.
By downloading, installing, or using the App, you consent to the practices described in this Privacy Policy and agree to its terms. This Privacy Policy forms part of the App's Terms of Use. If you do not agree with this Privacy Policy, please do not use the App.
2. Definitions
In this Privacy Policy:
"Personal information" (called "personal data" in some laws) means information that identifies, relates to, or could reasonably be linked with a particular person, directly or indirectly, such as a name, an email address, precise location, or an IP address.
"Device" means the phone, tablet, or watch on which you use the App.
"App Store" means the Google Play Store or the Apple App Store.
"Third-party service" means a service that is not operated by us, such as the station service, maps app, Google Play services, and App Stores described below.
3. Information We Collect
We do not collect personal information through the App. The App is designed to work on your device. It has no user accounts, logins, or passwords, does not ask for your name or email address, and has no servers of its own.
We do not collect, log, or monitor device identifiers, advertising identifiers, contacts, photos, usage analytics, crash reports, or any other data from your device or about you. The App does not use cookies, sessions, tracking pixels, or similar tracking technologies, shows no advertising, and does not communicate with any analytics, advertising, retargeting, or tracking service.
The App uses the internet for one purpose only: the CNG station search described in Section 4. Sections 5 and 6 describe information the App keeps on your device and sends to a paired watch. Section 7 describes what we receive if you choose to email us.
4. Location and the CNG Station Finder
The App uses your device's location only when you open the CNG station finder and allow location access, to find the public compressed natural gas (CNG) stations nearest you. The App reads your location once for each search and never reads it in the background.
For each search, your device's approximate or precise coordinates, rounded to about 100 meters, are sent over an encrypted (HTTPS) connection to the U.S. Department of Energy's Alternative Fuel Stations service (developer.nlr.gov), together with the App's key for that service, and the service returns a list of nearby stations. As with any request over the internet, that service also receives your device's IP address.
We do not receive, store, or have access to your location: it goes from your device to that service and nowhere else, and the App does not keep it after the search. The service's handling of the request is governed by its own terms and privacy practices.
Location access is optional. You can refuse it or turn it off at any time in your device's settings, and every other part of the App works without it.
5. Information Stored on Your Device
To save you time on your next trip, the App saves the following on your device, using your device operating system's standard local app storage:
- the tank capacity, estimated miles per gallon, and fuel type you enter, and, for a CNG truck, whether it is a box truck or a semi;
- while a trip plan is open, that trip's details: trip miles, fuel gauge readings, any fuel-up corrections you enter, and which stops are marked done, so the plan is still there if the App is closed and reopened mid-trip;
- your language and display style choices; and
- the date and time you agreed to the App's Terms of Use.
This information never leaves your device, except as described in Section 6 for a paired watch. It is not sent to us, to an App Store, or to any other third party, and we have no access to it, no ability to retrieve it, and no copy of it. The App excludes it from cloud backup and from transfer to a new device.
Trip details are cleared when you go back to the trip form or start a new trip. All of this information is deleted when you clear the App's data in your device's settings or uninstall the App.
6. Wear OS Watches
If you pair a Wear OS watch, the App sends the DriveAway GTG tile on that watch, for each of the trip's stops, the fuel amount, the fuel gauge reading, its place in the trip (such as "Stop 2 of 4"), and whether it is done, together with the App's button labels and short status messages (such as "All stops done").
This information travels through Google Play services between your phone and the paired watch, which may route it through Google's servers when the two are not connected directly. Google's handling of it is governed by Google's own privacy policy. It is never sent to us.
7. Emails You Choose to Send Us
The App's Contact Us option does not send anything by itself: it opens your own email app with a message addressed to us, which you can review, change, or discard. If you send it, or otherwise email us, we receive what the email contains: your name and email address, your message, and, for a bug report, the App version and your device's manufacturer, model, and Android version that the App fills in for you.
We use an email only to read and answer it, to fix problems it reports, and to improve the App, and we keep it only as long as needed for those purposes or as required by law. We do not add you to any mailing list. You can ask us to delete an email you have sent us, as described in Section 18.
8. App Store Purchases
If you obtain the App through an App Store, your purchase or download is processed entirely by that App Store using the Google or Apple account you use with it. The App Store may provide us with limited transaction information (such as an anonymized or aggregated confirmation that a purchase was made, for the purpose of verifying your purchase and providing you with the App's features) in accordance with that App Store's own privacy policy and terms.
We do not independently collect, request, store, or have access to your Google account, Apple ID, payment card details, billing address, or any other personal account information; that information is held and governed by Google or Apple, as applicable. We encourage you to review the privacy policy of the App Store you use.
9. No Sale, Rental, Lease, or Sharing of Information
We do not sell, rent, lease, trade, or otherwise share or disclose personal information to any third party for any purpose, including marketing, advertising, or cross-context behavioral advertising. Because we do not collect personal information through the App, there is no such information in our possession to sell or share. Your location, when you search for CNG stations, goes directly from your device to the U.S. Department of Energy's station service only to answer that search, as described in Section 4.
10. Data Retention
We keep no personal information from your use of the App, because none reaches us. Emails you choose to send us are kept only as described in Section 7.
Information the App saves on your device stays there until it is cleared as described in Section 5, or until you clear the App's data or uninstall the App. Third-party services keep what they receive under their own policies.
11. Sale of Business and Affiliates
If the Company, the App, or substantially all of the Company's assets are sold, merged, or otherwise transferred, including in a bankruptcy, reorganization, or similar proceeding, or if we share the App's operation with a company that controls, is controlled by, or is under common control with the Company (an "affiliate"), any information we hold at that time may be transferred as part of that transaction, and this Privacy Policy will continue to apply to it unless you are notified otherwise and, where the law requires, asked for your consent. Today we hold no personal information from the App, apart from any emails you have chosen to send us.
12. Third-Party Services and Links
The App does not include any third-party analytics, advertising, crash-reporting, or social media software development kits, and it does not use the Google Maps API. It works with these third-party services, each of which is operated independently of us and governed by its own terms and privacy policy, not by this Privacy Policy:
- the U.S. Department of Energy's Alternative Fuel Stations service, which answers CNG station searches (Section 4);
- the maps app on your device, which the App opens when you ask for directions to a station, and which handles what you do there;
- Google Play services, which carries information to a paired Wear OS watch (Section 6); and
- the App Store you obtained the App from (Section 8).
When you leave the App for another app or website, this Privacy Policy no longer applies. We are not responsible for the content or privacy practices of third-party services, and we encourage you to read their policies.
13. Children's Privacy
The App is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Because the App does not collect personal information from any user, this is true for users of every age. If you are a parent or guardian and believe that a child under 13 has sent us personal information, for example by email, please contact us as described in Section 21 and we will delete it.
14. Data Security
Because we do not collect personal information through the App, there is no central database of your personal information for us to secure or that could be compromised in a data breach on our end. The CNG station search described in Section 4 uses an encrypted (HTTPS) connection. We take reasonable measures to protect emails you send us.
Information saved on your device, as described in Section 5, is protected by the security features of your own device and operating system, and it is your responsibility to secure your device accordingly. No method of storage or transmission is completely secure.
15. International Use
The App is offered from the United States. If you use the App from outside the United States, no personal information is collected, processed, or transferred by us in connection with your use of the App, regardless of your location. A CNG station search sends your coordinates to a U.S. government service, as described in Section 4; its station data covers the United States and Canada. If you email us from outside the United States, your email is received and handled in the United States.
16. Your Rights in the EEA, UK, and Switzerland (GDPR)
If you are in the European Economic Area, the United Kingdom, or Switzerland, data protection laws such as the General Data Protection Regulation (GDPR) give you rights over personal data that a company holds about you: to access it and receive a copy, to have it corrected, to have it deleted, to restrict or object to its use, to receive it in a portable format, and to withdraw any consent you gave. You also have the right to complain to your local data protection authority.
Because the App does not send us personal data, we hold nothing from your use of the App that we could give you, correct, delete, restrict, or transfer. The only personal data we may hold about you is an email you chose to send us, which we use to answer you on the basis of our legitimate interest in responding to messages, and to which all of these rights apply.
The information the App keeps on your device is under your control: you can delete it at any time by clearing the App's data or uninstalling the App. You can withdraw consent to location access at any time in your device's settings.
17. Your California Privacy Rights (CCPA and CalOPPA)
If you are a California resident, the California Consumer Privacy Act (CCPA) gives you the right to know what personal information a business collects about you, its sources and purposes, and with whom it is shared; to access, correct, and delete it; to opt out of its sale or sharing; to limit the use of sensitive personal information; and not to be discriminated against for exercising these rights.
In the past 12 months we have not collected personal information through the App. The only personal information we may have received is what you chose to include in an email to us (identifiers such as your name and email address, the contents of your message, and device details in a bug report), used only to answer you, as described in Section 7. We do not sell or share personal information, and have not done so, so there is nothing to opt out of. We do not use or disclose sensitive personal information for any purpose that would give you a right to limit it. We will not discriminate against you for exercising any of these rights.
Under the California Online Privacy Protection Act (CalOPPA), we disclose that the App does not track you over time or across third-party websites or services, and therefore does not respond differently to "Do Not Track" browser signals. We will post any changes to this Privacy Policy in the App, as described in Section 19.
18. How to Exercise Your Rights
To exercise any of the rights described in Sections 16 and 17, or to ask any question about your personal information, contact us as described in Section 21. We may ask for information needed to confirm that a request about an email is from the person who sent it. You may use an authorized agent where the law allows. We will respond within one month of receiving your request, or sooner if the law requires. To delete the information the App keeps on your device, you do not need to contact us: clear the App's data or uninstall the App.
19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time, for example to reflect changes in the App's functionality or for legal or regulatory reasons. If we do, we will update the "Effective date" above and make the revised policy available in the App. Before a material change takes effect, such as the App beginning to collect information it does not collect today, we will notify you in the App and give you an opportunity to review it. Your continued use of the App after a revised Privacy Policy becomes effective constitutes your acceptance of it. If you do not agree to a revised Privacy Policy, stop using the App and uninstall it.
20. Governing Law
This Privacy Policy, and any dispute arising out of or related to it or to the App, is governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles, and, where applicable, the federal laws of the United States. Disputes are resolved as described in the Terms of Use. This does not take away any rights you have under the privacy laws of the place where you live.
